PROCEDURES FOR REGISTRATION FOR FOREIGNERS RENTING HOUSE IN VIETNAM

Under the provisions of Vietnamese law when you have a rental house you will be considered as an individual business household and must register Business and pay taxes related to business activities as a business. In case your tenant is a foreigner, you will need to follow other Legal procedures for registration according to the procedure below to ensure that you do not violate the residence law.

STEP 1: BUSINESS REGISTRATION (OPERATING FOR LEASE)
The rental business is a conditional business. To register the business, you must go to the People’s Committee of the district where you have a rental house to register when registering you need the following documents:

  • Documents proving house owner for lease (Red book or house contract)
  • ID card

STEP 2: PAY THE LETTER TAX AND DECLARATION CODE OF APARTMENT TAX NUMBER
Paying business license tax and Tax Code Declaration help tax authorities control your business. The full tax payment in business activities is both a responsibility and an obligation to help develop the country.

Documents and tasks include:

  • Business registration certificate in step 1
  • Apartment Tax Declaration (District Tax Department)
  • License tax return

STEP 3: REGISTER SECURITY ORDER AT THE POLICE IN DISTRICT
The security order registration helps the management agency control the residence and stay of foreigners in Vietnam. If you skip this step and hire a foreigner when it is discovered that you have inadvertently violated the law and are administratively fined by a competent authority.

The dossier includes:

STEP 3: REGISTER SECURITY ORDER AT THE POLICE IN DISTRICT
The security order registration helps the management agency control the residence and stay of foreigners in Vietnam. If you skip this step and hire a foreigner when it is discovered that you have inadvertently violated the law and are administratively fined by a competent authority.

The dossier includes:

  • Curriculum vitae of the householder
  • An application for a certificate of satisfaction of security conditions to conduct a conditional business
  • Business registration certificate
  • Registration form of fire prevention and fighting conditions (required by each project)

STEP 4: DECLARATION OF TEMPORARY RESIDENCE FOR THE CLIENT IN THE POLICE OF WARD
Tenants, in this case, are interpreted as foreigners. After you have completed the above 3 steps, you are sure that you are eligible to rent the house according to the law. If the tenant is a foreigner, the application and procedure will include the following documents:

  • Declaration of temporary residence for foreigners
  • House lease contract
  • Past Post (The period of stay in Vietnam and Visa must be a Working Visa)
  • Certificate of security order issued by the district police
    Business license
  • Certificate of ownership of a rental house (Red Book or Housing Contract)
  • Landlord’s identity card (Notarized)

STEP 5: PAY INDIVIDUAL INCOME TAX
Paying PIT is the final step to complete the rental process for guests. If you have to pay PIT as required by law, you must complete this step by going to the county tax department to file a tax return, which includes :

  • House lease contract
  • Tax declaration handing to the tax authorities
    After receiving the confirmation of the tax you must pay, you will bring the certificate of personal income tax declaration to the treasury to pay into the state budget.
